RETURN POLICY

The right to refuse the purchase and return goods without giving a reason

According to PPE and Dir. of the EU, consumers have the right to withdraw from the contract (the online purchase) without giving a reason within 14 days after receiving the goods.

If the consumer decides within the 14-day period to proceed with the return, he must inform the trader of his decision before the expiry of the period. This can be done by sending an opt-out form or other appropriate communication.

The consumer then has up to 14 more days to send the goods back. In this period, the time required for the return delivery is not considered, but only until the shipment.

In the case of returning goods, the costs are borne by the consumer, unless the trader has assumed this responsibility or they have agreed with the consumer to assume it after carefully considering the complaint made about the goods. In the event that there were no additional conditions, the user is obliged to undertake the organization of the shipment and the payment of the costs related to the transport.

 

Terms for returning goods and requirements for retaining the right of return

There are two main terms to consider:

  • Cancellation period – 14 days from the date of delivery;
  • Return period – 14 days after refusal.

The main deadline is the previously mentioned 14-day cancellation period. It gives the consumer the right to withdraw from the contract and return the goods without giving a reason within 14 days of receiving the goods.

The start of the 14-day cancellation period starts from the date of delivery of the shipment. If this is a physical delivery, it will be different from the order date. If it's electronic, it'll probably be the same.

The right to return goods is exercised after the right to refuse. A 14-day return period starts from the day the consumer informs the merchant that he wants to return the goods. In this case, "return" means sending the goods.

In total this makes 14+14 or 28 days for the notification and the return itself.

 

Conditions for returning goods in original packaging and condition

 

  • Original packaging. The most important thing when returning a product that was purchased online is that it be in its original packaging. It must not be damaged or altered (not painted over or replaced with another of the same size).
  • Condition of the goods. In order to be entitled to a return of a product, it must be in the same condition in which it was received. It must not be damaged and, in the best case, even used. If it has been used, it must not have been altered or have no signs of use. For example, the conditions for returning a laptop would depend on the conditions of the merchant if it has already been unpacked, even if it has not been used yet (provided there are no other defects).
  • Labels and markings. All labels, stickers, markings and other signs on the goods must be intact upon receipt. For example, a garment without a tag may be accepted by a store that has a policy of accepting clothing in that condition, but not every store necessarily does.
  • Accessories and additional parts. All items other than the main one included in the package with the product must be returned with it. However, when negotiating a partial refund, there may be a condition that mentions the retention of some of the accessories or additional parts.

 

Returning goods that are defective or not as described

According to EU law, the consumer has the right to request a repair, replacement or refund when he finds that the purchased goods are defective or do not correspond to the description. A complaint requires the merchant to examine the item and determine if there is a problem. If so, it is obliged to fix it by offering to repair, replace the goods or refund the buyer

The complaint procedure is as follows:

  1. The user receives the goods and finds a defect or discrepancy with the description.
  2. Contact the merchant as soon as possible by phone, email or by submitting a claim form, providing all necessary documents such as receipt and invoice.
  3. The trader examines the complaint and, if it is justified, repairs the goods, replaces them or returns the money to the user.

Refund when returning an item

If the user has complied with the following conditions, he is entitled to a refund:

  • Observed the legal 14-day period for returning goods after notifying the merchant within another 14 days of receipt.
  • In the event of a defect or discrepancy with the description, informed the merchant as soon as possible and provided proof.
  • He gave time to the merchant to process his complaint (in case of defects – 30 days).
  • He sent the goods back at his own expense or at the merchant's expense.

In Bulgaria, the standard period for returning the payment from the merchant is 14 days. This term begins to run from the moment after the goods are delivered back. If there is a defect, then the 30-day test and diagnosis period should first expire.

The merchant must refund the buyer via the same payment method.

Costs and responsibilities related to returning goods

There is no return law that says the merchant has to take delivery back when the item is not damaged. In most cases, these costs are borne by the user.

For example, in case of injuries during delivery, the courier company must take responsibility and refund the money to the consumer. However, if the consumer did not document the opening of the product, they may have to pay for injuries to the product in the form of deductions from the merchant.

By the same logic, the consumer must make sure that the goods are packed properly for transport in order to avoid damage during transport. In the case of cancellation of the sales contract, the goods must be returned in the original packaging, while in the case of a defect this is not mandatory, although it is a good practice.

 

Process and procedures for returning goods, including necessary documents

The steps for returning a product are as follows:

  1. Return Notice. The user must contact the merchant to terminate the contract within the 14-day return period for goods purchased from an online store.
  2. Completion of return form and documents.
  • Proof of purchase. The merchant always requires some form of proof that the consumer purchased the goods from him and not from someone else. This is the same as when returning an item with a receipt in a physical store. Online, this could be an invoice or an email about the transaction made.
  • Product return form. Some merchants require the completion of a special form available online on the store's website or sent with the goods. It contains information about the buyer, the product and the reason for the return. By law, the consumer is not required to fill in the reason if he initiates the return within 14 days of receipt.
  1. Packaging and sending the goods. After notifying the merchant, the consumer must take care to pack the goods in the original packaging, including all accessories and documents that came with it. Finally, he has to send it on time.
